SHOULD I PAY ANY TAXES IN SPAIN IF I AM NON-RESIDENT?
Are you Non-Resident in Spain but you own a property? Then, hold on for a second, because, unfortunately, the answer is YES. The Spanish Law establishes that, when you own a property in Spain, you must pay a yearly tax which is called “Non-Resident Tax”. The Spanish Tax System can be a complicated issue, as the regulations are often changing and, also, if you don’t comply adequately with the rules, the fines can be quite high. But don´t worry, we are here to help you and make sure you don´t fail with your obligations as a homeowner in Spain.
LET’S CLARIFY THE “RESIDENT” CONCEPT
You would be a Fiscal Resident in the country where you spend more than 183 days in the year, whether they are in a continuous period or by intervals and regardless of whether you are formally registered.
WHAT EXACTLY IS NON-RESIDENT TAX?
This is a state tax payable by everyone who owns a property (house, garage, storage…) in Spain, but is a fiscal resident in another country. It comes directly from the Spanish Main Tax Office and must be calculated, submitted and paid every year with a declaration (210 model) of every owner and property.
HOW IS THIS TAX CALCULATED?
The Non-Resident Tax is calculated based on the cadastral value of the property, cadastral reviewing year and percentage of ownership. Percentages stay now at 19% or 24%, depending on the country you are a Fiscal Resident. No deductions or allowances can be applied in this tax.
WHEN DO I NEED TO PAY IT?
The period to pay this tax starts the 1st of January and ends the 31st of December. That means you will have all the natural year to pay taxes from the previous period.
